1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of the Got A Thing Need A Thing website, mobile experience, and related services (the "Platform"), operated by Got A Thing Need A Thing, LLC, a Georgia limited liability company ("GTNT," "we," "us," or "our"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

2. What Got A Thing Need A Thing Is (and Isn't)

GTNT operates an online marketplace that connects individuals who own tools, lawn equipment, and similar personal items ("Owners") with individuals who want to rent those items ("Renters"). GTNT is a neutral intermediary: we facilitate listings, bookings, payments, and dispute assistance, but we are not a party to the rental agreement formed between an Owner and a Renter when a booking is accepted.

GTNT does not own, possess, inspect, or take custody of any listed item at any point. We do not guarantee the accuracy of any listing, the condition or safety of any item, or the conduct of any user.

3. Eligibility

  • You must be at least 18 years old and able to form a binding contract.
  • You must be using the Platform as an individual acting in a personal capacity — not as a business, rental company, or on behalf of one. GTNT is built for individuals renting out personal equipment they own; if a business tier is offered in the future, it will be a separate product with separate terms.
  • You must reside in, and the item pickup/return must occur within, the United States.
  • You must provide accurate registration information and keep it up to date.
  • GTNT does not perform criminal background checks on users and does not screen users beyond the identity verification described in Section 4. You are responsible for your own safety when meeting another user or using a rented item.

4. Accounts and Identity Verification

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorized use.

GTNT requires identity verification for both Owners and Renters through our payment processor's identity verification service before certain actions (such as publishing a listing or completing a paid booking) become available.

At signup, Owners must certify that they are acting as an individual and not a business. GTNT may spot-check this certification during listing review and may reject or remove a listing, or suspend an account, if this certification appears false.

5. Listings

If you list an item as an Owner, you represent and warrant that:

  • You lawfully own the item, or have the legal right to rent it out;
  • The item is legal to own, possess, and rent in your jurisdiction;
  • The listing description, condition notes, and photos are accurate and not misleading;
  • You will honor the price and availability shown on an approved listing unless you update or remove it before a booking request is accepted.

Every listing is reviewed by GTNT before it becomes publicly visible. GTNT may approve, reject, or later remove any listing for any reason, including suspected policy violations, at its discretion. Listing approval is a quality and policy check only — it is not a certification of the item's safety, legality, or condition, and does not shift responsibility for those matters away from the Owner.

6. Prohibited Items and Uses

The following may not be listed or exchanged through the Platform:

  • Firearms, ammunition, explosives, or other weapons;
  • Illegal items, or items whose rental would violate any law or regulation;
  • Hazardous materials, or items requiring a license or certification GTNT has not verified you hold;
  • Stolen property or items you do not have the right to rent out;
  • Items subject to a manufacturer or government safety recall, or that the Owner knows to be defective or unsafe;
  • Items intended for use in an illegal activity.

You may not use the Platform to operate a commercial rental fleet, to circumvent GTNT's fees by arranging payment outside the Platform after connecting through it, or to harass, defraud, or endanger another user.

For gas-powered equipment, ladders, and power tools, the Owner must confirm the item is in safe working condition and disclose any known defect, and the Renter accepts the risks of operating the item and agrees to follow the manufacturer's instructions and safety warnings.

7. Booking Process

A Renter requests to rent a listed item for specific dates. The Owner may accept or decline that request. Once an Owner accepts, a binding rental agreement is formed directly between the Owner and the Renter for those dates and terms; GTNT is not a party to that agreement, but it does govern related use of the Platform (payment, deposit, documentation, and dispute-assistance provisions) under these Terms.

Every booking has a firm return deadline. Failing to return an item by that deadline may result in additional charges, loss of deposit, suspension from the Platform, and may expose the Renter to claims by the Owner independent of GTNT.

8. Fees, Pricing, and Payments

Owners set their own rental price for each listing. GTNT does not dictate pricing.

GTNT charges a platform commission of 15% of the rental price, subject to a minimum of $3.50, deducted from the Owner's payout. Commission is charged on each booking for which the Owner is paid, as described in Section 11. The Renter pays exactly the listed price (plus any applicable tax, described in Section 13) — the commission is not added on top of what the Renter pays.

Payments are processed by our third-party payment processor (currently Stripe). GTNT does not directly store full payment card numbers. Owner payouts are issued via the payment processor's connected-account system. GTNT is not a bank and does not hold customer funds outside of that processing relationship. Fees charged by GTNT are GTNT's own and are not imposed or controlled by the payment processor. Payout timing is determined by the payment processor and the Owner's bank, not by GTNT.

9. Security Deposits

A booking may include a refundable security deposit hold placed on the Renter's payment method at or before the start of the rental. Because a card authorization typically expires after about seven days, GTNT may place a new hold for the same amount before an existing hold expires on rentals lasting longer than that. Only one hold is intended to be effective at a time, and a Renter may briefly see more than one pending amount while a replaced hold clears. A hold is not a charge. On a clean return, the hold is released. If the Owner reports damage or loss, GTNT will review the pickup/return condition photos submitted by both parties and may, at its reasonable discretion, capture some or all of the deposit to compensate the Owner.

This deposit hold is not insurance and does not guarantee full compensation for any damage or loss. It is a good-faith mechanism based on the evidence available to GTNT at the time of review.

GTNT makes deposit determinations as a limited administrative convenience for the Owner and the Renter, not as an adjuster, appraiser, or insurer. A Renter may dispute a determination by submitting a written objection through the Platform within 7 days after GTNT notifies the Renter of the decision, and GTNT will review any additional evidence before the determination becomes final. A deposit determination resolves only how the deposit hold is applied. It does not decide the legal liability between the Owner and the Renter, who keep their independent rights against each other.

10. Condition Documentation

Both parties are required to upload photos of the item's condition at pickup and again at return. This documentation is the primary evidence used to resolve condition disputes and deposit decisions. Failure to submit documentation may weaken a user's position in a later dispute.

11. Cancellations

A Renter may cancel a pending or accepted booking request through the Platform. An Owner may decline a pending request at their discretion with no obligation to the Renter.

Unless a listing states otherwise, the following applies when a Renter cancels an accepted booking:

  • Cancellations made 24 hours or more before the rental start time: full refund of the rental price, less any non-refundable payment-processing fee.
  • Cancellations made less than 24 hours before the rental start time: 50 percent refund of the rental price, less any non-refundable payment-processing fee.
  • Cancellations made after the rental start time, and no-shows: no refund.

If an Owner cancels a booking they have already accepted, the Renter is refunded the rental price and any tax collected in full, with no deduction from the Renter for any non-refundable payment-processing fee, however close to the rental start time the cancellation occurs.

An Owner who cancels 24 hours or more before the rental start time owes nothing. Where an Owner cancels less than 24 hours before the rental start time, GTNT may recover any non-refundable payment-processing fee incurred on that booking from that Owner, including by deducting it from amounts payable to that Owner on a later booking.

Any security deposit hold not applied under Section 9 is released regardless of when a cancellation occurs. GTNT's platform commission is not charged on a booking cancelled before the rental start time. On a cancellation by the Renter after the rental start time, and on a no-show, no refund is due: the Owner is paid as on a completed booking and GTNT's commission applies in the same way.

12. Reviews and Ratings

After a completed rental, both parties may leave a rating and review of the other. Reviews must reflect genuine experiences and may not contain false statements, harassment, or content unrelated to the rental. GTNT may remove reviews that violate this policy but is not obligated to monitor all reviews before publication.

13. Taxes

GTNT may collect applicable state and local rental/sales tax on transactions at checkout and remit it on behalf of Owners, in its capacity as a "marketplace facilitator" under applicable state law, even where not yet legally required to do so. This does not make GTNT responsible for an Owner's personal income tax obligations on their rental earnings — Owners are solely responsible for reporting and paying any income tax owed on amounts they receive through the Platform.

14. User Conduct

You agree not to:

  • Provide false information on your account, a listing, or a booking;
  • Attempt to complete a transaction outside the Platform to avoid fees after connecting through it;
  • Harass, threaten, or discriminate against another user;
  • Use the Platform for any unlawful purpose.

Messages and condition photos exchanged through a booking are sent through and stored by the Platform. GTNT may review them to resolve a dispute, to investigate a report, and to enforce these Terms, including deciding whether to suspend or close an account. Do not use Platform messaging to arrange a transaction outside the Platform, to harass another user, or to send unlawful content.

15. Disputes Between Users

GTNT is not responsible for the acts or omissions of any Owner or Renter, the condition, safety, or legality of any listed item, or the outcome of any rental. Where a dispute arises between an Owner and a Renter (including over damage, deposit capture, or a return dispute), GTNT may review evidence submitted through the Platform and make a good-faith determination as described in Section 9, but is not obligated to mediate and its determinations regarding deposit holds are final as between GTNT and the users, without prejudice to either user's independent legal rights against the other.

16. Disclaimers

THE PLATFORM AND ALL LISTED ITEMS ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. GTNT DOES NOT INSPECT LISTED ITEMS AND MAKES NO WARRANTY, EXPRESS OR IMPLIED, REGARDING THE QUALITY, MERCHANTABILITY, SAFETY, LEGALITY, OR FITNESS FOR ANY PARTICULAR PURPOSE OF ANY ITEM LISTED OR RENTED THROUGH THE PLATFORM.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GTNT'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID THROUGH THE PLATFORM IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) $100. GTNT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS OR LOST DATA, EVEN IF GTNT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTHING IN THIS SECTION LIMITS OR EXCLUDES GTNT'S LIABILITY FOR ITS OWN GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR FRAUD, FOR DEATH OR PERSONAL INJURY CAUSED BY GTNT'S NEGLIGENCE, OR FOR ANY OTHER LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER GEORGIA LAW.

18. Indemnification

You agree to indemnify and hold GTNT harmless from any claim, loss, or damage, including reasonable attorneys' fees, arising from your use of the Platform, your listing, your rental of an item, or your violation of these Terms. This obligation does not apply to the extent a claim arises from GTNT's own gross negligence, willful misconduct, or fraud. GTNT will notify you of any claim subject to indemnification, and you will cooperate in the defense. GTNT may assume the exclusive defense and control of any matter subject to indemnification, and you will not settle any claim in a way that creates an obligation for GTNT without GTNT's prior written consent.

19. Suspension and Termination

GTNT may suspend or terminate your account for violation of these Terms, suspected fraud, safety concerns, or at its discretion, with notice where practicable. You may close your account at any time by requesting closure through the Platform or by contacting GTNT at the address in Section 24. Obligations arising from bookings already in progress survive account closure.

20. Intellectual Property

The Platform, its design, and its branding are the property of GTNT. By posting content (including listing photos and descriptions), you grant GTNT a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, and distribute that content in connection with operating and promoting the Platform.

Copyright Complaints and Takedown

GTNT respects the intellectual property rights of others and responds to notices of claimed copyright infringement involving content on the Platform. To report content you believe infringes your copyright, send a written notice to GTNT’s designated copyright agent that includes the following.

  • Your physical or electronic signature.
  • The copyrighted work you claim was infringed.
  • The material you claim is infringing and where it appears on the Platform.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act for the owner.

GTNT may remove or disable access to material identified in a proper notice, and may end the accounts of users who repeatedly infringe. Send notices to GTNT’s designated copyright agent at Jordan Thomas, PO Box 332, Sylvania, GA 30467, and dmca@gotathingneedathing.com.

21. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules.

Informal resolution first. Before starting arbitration, you and GTNT agree to try to resolve any dispute informally. The party raising the dispute will send written notice to the other, and both will allow 30 days to reach a resolution.

Binding arbitration. Any dispute not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Screven, Georgia, or by phone or video at your election. Judgment on the award may be entered in any court with jurisdiction.

Class action waiver. You and GTNT agree to bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any class, collective, or representative action.

30-day opt-out. You may opt out of arbitration and the class action waiver by sending written notice to GTNT within 30 days after you first accept these Terms. If you opt out, disputes will be resolved in the state or federal courts located in Screven, Georgia, and you and GTNT consent to the personal jurisdiction and venue of those courts.

Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief to protect its intellectual property, without first using arbitration.

22. Changes to These Terms

GTNT may update these Terms from time to time. For material changes, GTNT will provide notice by email to the address on your account or by an in-Platform notice at least 14 days before the change takes effect, and will update the effective date at the top of these Terms. Continued use of the Platform after a change takes effect constitutes acceptance of the revised Terms. If you do not agree to a change, you must stop using the Platform and may close your account.

23. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and GTNT regarding the Platform. GTNT's failure to enforce a provision is not a waiver of that provision. GTNT may assign these Terms, in whole or in part, to an affiliate or in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without GTNT's prior written consent, and any attempted assignment without consent is void. Neither party is liable for any delay or failure to perform caused by events beyond its reasonable control, including natural disasters, labor disputes, or failures of third-party services. The provisions that by their nature should survive termination, including Sections 15 through 18, 20, and 21, survive termination or expiration of these Terms.
